What tachograph rules apply to vans over 2.5 tonnes from July 2026?

This is one of the questions we're regularly asked by transport managers and operators - so here's the straight answer from our analysts.

Short answer

Vehicles and vehicle combinations that exceed 2.5 tonnes maximum permissible mass travelling cross border for hire or reward fall in scope of EU tachograph regulations as of 01/07/26 under Regulation (EC) No 561/2006 Article 2. The regulation update does not affect LCVs and small vehicle combinations that travel solely in the UK.

Regulation

The regulation update specifies ‘goods in international transport operations or in cabotage operations, where the maximum permissible mass of the vehicle, including any trailer or semi-trailer, exceeds 2.5 tonnes, or, of passengers by vehicles which are constructed or permanently adapted for carrying more than nine persons including the driver, and are intended for that purpose…fall within scope’.

Who’s affected

The update directly affects small removals vans, parcel delivery vehicles and small freight, specialist vehicle and trailer combinations that do not qualify under any exemptions and small passenger vehicles of more than 9 seats. Localised transport will not be affected as this is a cross-border regulation update only.

The regulation update reduces the hard ceiling of 3.5 tonnes maximum permissible mass down to 2.5 tonnes maximum permissible mass, retains the existing 3.5 tonne threshold for domestic operations, creating a compliance trap.

Updates

Operators not already holding a Standard International goods vehicle operator licence must apply for an upgrade or variation before 1 July 2026; the application triggers Traffic Commissioner scrutiny of the operator's full compliance record, making prior preparation essential rather than incidental. Financial standing must be demonstrably met at £1,600 for the first light vehicle, £800 per additional light vehicle, with a major variation costing £257, and a transport manager holding a Transport Manager CPC must be nominated (if not already) without which the application will not succeed. 

Equipment compliance requires retro fitment of a Generation 2 Smart tachograph unit under Regulation (EU) No 165/2014 Article 3 (1b) on any vehicle entering scope that either carries no tachograph or an older unit; company policies, download and analysis procedures and data hosting systems must all be configured to manage the new data chain before the first regulated journey commences. 

The shift to EU drivers' hours rules under Regulation (EC) No 561/2006 Article 2 (3) materially changes what drivers must record and carry: record-keeping requirements extend from 28 to 56 calendar days for UK-EU cross-border operations and the maximum daily duty allowance increases from the 11-hour GB domestic ceiling up to 15 hours on days when a reduced daily rest of 9 hours is taken, a structural change that requires drivers to understand a substantially different compliance framework before they get behind the wheel.

Driver CPC confusion

Digital systems require implementation to store and analyse digital tachograph files, along with the process of downloading and uploading vehicle units and driver cards. Driver cards must be applied for, and drivers must undertake comprehensive training on digital tachograph use. 

Drivers in the 2.5 tonnes-3.5 tonnes weight bracket do not require a certificate of professional competence as the vehicle regulation has not changed, only the inclusion of a tachograph, creating a potential knowledge gap and risk of non-compliance. Professional training is strongly advised for drivers in this bracket.
